    Are Gay Ketubahs Valid?

    A question we get all the time is, are Gay Ketubahs valid?

    Some thoughts on that issue.

    Importantly, some religions are centralized, top-down. Think the Catholic Church, starting with the Pope and working his way down.

    But Judaism is deeply decentralized — and has been for thousands of years. Just remember the medieval rabbis: Rambam (Maimonides), Rashi — the great rabbis of the Talmudic era — each rabbi had a different interpretation. And each Jew would follow the rabbi he believed in.

    We see this today, in every aspect of Judaism. Take our humor: “Two Jews, Three Opinions.” Take the number of Jewish organizations and groups and sub-groups and affiliations and alliances — the number of them is basically the same as the number of Jews!

    The closest Judaism today has to a centralized authority is what the government of Israel says. And that is still very variable: for example, Israel itself only allows for ultra-orthodox weddings. Famously, the Israeli Supreme Court Judges get married in Cyprus because, according to the laws of Israel (of which they are on the Supreme Court!), they can’t even get married in a non-Orthodox way. So this is far, far from binding.

    As a result of this deep decentralization, what matters most is, what your rabbi or officiant says. We’ve worked with hundreds of different couples, and have seen hundreds of different Rabbinic opinions! So really all that matters is the opinion of your rabbi or officiant on this issue. If your rabbi will oversee and sign it–then great!

    The final point is, the most important observation is that the main use of the Ketubah is, if you get a get for a divorce. This is the primary situation under which the Ketubah is used and enforced. So here, too, keep in mind that for a rabbi to accept a Ketubah to use in dealing with the get, he needs to first accept the Ketubah–so it should be your same Rabbi. But hopefully, that will never happen to any of you, since hopefully none of us will get divorced.

    New Zealand’s First Same-Sex Wedding…. On a Plane!

    Here at Bagel we make sure to stay updated and active on the latest Equality Marriage laws, and perhaps celebrate a bit (okay, maybe a lot!) when yet another historical day is made and Same-Sex marriage is legalized. For those who haven’t read/heard/seen in the news or your twitter feeds, this past Monday New Zealand has joined in granting the most basic right and pleasure for two people in love, the freedom to get married. New Zealand is only the 14th country in the world to legalize marriage, but the FIRST Asia-Pacific Country!

    Amidst all this excitement and revolutionary change, emerges the touching story of Lynley Bendall and Aly Wanikau who were finally able to tie the knot that same Monday. Not only was their wedding beautiful and full of joy, love and excitement, but all of this took place on a decked out New Zealand airplane. If that wasn’t already amazing enough, Modern Family cast member and gay marriage advocate, Jesse Tyler Ferguson attended and took part in their ceremony!!

    They even put together a short video about Lynley and Aly’s story as a couple. We were so touched that we just had to share their story. Congratulations Lynley and Aly, and Congratulations to New Zealand as well! We couldn’t be more excited and overjoyed that Same-Sex couples have the freedom to honor their love and devotion to one another through the freedom of marriage.

    The Forward on Shlomo Ashkinazy: “Gay, Orthodox and Outspoken”

    The Forward does it again:

    “Enter Shlomo Ashkinazy. A quiet but pathbreaking activist, Ashkinazy has counseled gay and lesbian Orthodox Jews about reconciling “untenable contradictions” in their religious and sexual identities. Most recently, he’s leading a video storytelling project for Eshel, the New York-based organization which advocates for acceptance of LGBT Jews in Orthodox communities.”

    What’s incredible and wonderful is that, seemingly every other day there’s another article in the Forward about gay and lesbian Jews! They seem to very strongly support our rights. Go Forward! We love you! You are bringing our issues to the forefront of the American Jewish community more than any other media vehicle we know. Thank you!

    Love + Ahava

    There couldn’t be anything more classic than the Love statue in New York. It’s big, red, and completely romantic!! For those like me that are New Yorkers at heart, we totally hate on those people taking touristy photos, but secretly we all think the same thing: “I LOVE that statue!!!”. For many who don’t know, artist Robert Indiana also created a replica Love Statue in Hebrew, which says “Ahava”.
